{"id":471,"date":"2016-04-13T18:05:18","date_gmt":"2016-04-13T18:05:18","guid":{"rendered":"https:\/\/www.hallandgreenlaw.com\/?p=471"},"modified":"2016-04-13T20:04:02","modified_gmt":"2016-04-13T20:04:02","slug":"north-carolina-ignition-interlock-requirements","status":"publish","type":"post","link":"https:\/\/www.hallandgreenlaw.com\/index.php\/north-carolina-ignition-interlock-requirements\/","title":{"rendered":"North Carolina Ignition Interlock FAQs"},"content":{"rendered":"<p><strong>When is an Ignition Interlock required for me to drive?<img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-478 alignright\" src=\"https:\/\/www.hallandgreenlaw.com\/wp-content\/uploads\/2016\/04\/images.jpeg\" alt=\"images\" width=\"275\" height=\"183\" \/><\/strong><\/p>\n<ul>\n<li>You were convicted of DWI and had an alcohol concentration of 0.15 or\u00a0more; OR<\/li>\n<li>You have previously been convicted of DWI within 7 years from the date\u00a0of the current offense; OR<\/li>\n<li>You were convicted of this DWI and sentenced at Level 1.<\/li>\n<\/ul>\n<p><strong>How much alcohol can I consume and drive with the\u00a0Ignition Interlock?<\/strong><\/p>\n<ul>\n<li><strong><em>You blew a 0.15 or more:<\/em><\/strong>\n<ul>\n<li><span style=\"text-decoration: underline;\">During period of license revocation<\/span>: If you have the Ignition Interlock\u00a0installed during your period of revocation (meaning, you are driving with\u00a0a Limited Driving Privilege), you may not have anything to drink and then\u00a0drive. You alcohol concentration must be a <strong>0.00<\/strong>. \u00a0 \u00a0(**Please note: There is a 45-day grace period after conviction of the DWI\u00a0that you may not drive at all. After this time period, you may then be\u00a0eligible to install the Ignition Interlock.)<\/li>\n<li><span style=\"text-decoration: underline;\">License revocation period is over<\/span>: If your period of license revocation\u00a0is over, but you have not completed the Ignition Interlock requirement,\u00a0you license may be restored upon installation of the Ignition Interlock. \u00a0During this time period, you may not drive with an alcohol concentration\u00a0of <strong>0.04<\/strong> or greater during (see section below for information on how\u00a0long the Ignition Interlock must be installed).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><em><strong>You have been convicted of a prior DWI within 7 years from the date of\u00a0the current offense;\u00a0<\/strong><\/em><strong><span style=\"text-decoration: underline;\">OR<\/span>\u00a0<\/strong><em><strong>You were convicted and sentenced at Level 1 for this offense;\u00a0<\/strong><\/em><strong><span style=\"text-decoration: underline;\">OR<\/span>\u00a0<\/strong><strong><i>You were convicted of Habitual Impaired Driving for this offense<\/i>\u00a0<\/strong><em>(The\u00a0provision regarding Habitual Impaired Driving expires December 1, 2016. \u00a0These defendants will no longer be eligible to drive, even with an Ignition\u00a0Interlock)<\/em>\n<ul>\n<li>You may not drive with an alcohol concentration greater than <strong>0.00<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><em><strong>You blew a 0.15 or more AND you were also convicted (based on the\u00a0same offense) of\u00a0Driving while impaired in a commercial vehicle; <span style=\"text-decoration: underline;\">OR<\/span> Driving while less than 21 years old after consuming alcohol\u00a0or drugs; <span style=\"text-decoration: underline;\">OR<\/span>\u00a0Felony or misdemeanor death by vehicle or felony serious\u00a0injury by vehicle; <span style=\"text-decoration: underline;\">OR<\/span>\u00a0Manslaughter or negligent homicide<\/strong><\/em>.\n<ul>\n<li>You may not drive with an alcohol concentration greater than <strong>0.00<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>How long will I be required to have the Ignition Interlock\u00a0in my car?<\/strong><\/p>\n<p>The length of time depends upon the period of license revocation:<\/p>\n<ul>\n<li><span style=\"text-decoration: underline;\">License Revocation Period was ONE YEAR<\/span> \u2013 You must have the Ignition\u00a0Interlock installed for <strong>one year<\/strong>.<\/li>\n<li><span style=\"text-decoration: underline;\">License Revocation Period was FOUR YEARS<\/span> \u2013 You must have the Ignition\u00a0Interlock installed for <strong>three years<\/strong>.<\/li>\n<li><span style=\"text-decoration: underline;\">License Revocation Period was PERMANENT<\/span> (*permanent means you may\u00a0not have your license restored without a hearing before a DMV Officer) \u2013\u00a0You must have the Ignition Interlock installed fo<strong>r seven years<\/strong>.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>When is an Ignition Interlock required for me to drive?
